To renew your subscription after the initial 30 days, you can top up $200 to opt in.
6. Do I own the free router from the day it was given to me?
The ownership of the router will remain with Digicel until you complete the 360-day term for this Agreement. This means at the end of of your initial payment of $200 for Unlimited Data valid for 30 days, you will need to continue to subscribe to Unlimited Data plan eleven times more or every 30 days within the next 330 days. After the completion of the 360-day term, the ownership of the router will be handed over to you.
5. What will happen if I am not able to subscribe to the Unlimited Data ten times more after the initial 60 days?
Digicel Tonga may end this Agreement without cause and for convenience at its discretion. It may also end this Agreement and recover the Router / modem from you should you discontinue opting in to this Unlimited Plan within 300 days of the Creation Date (before end of Term).
You may also end this Agreement without cause and for convenience at your discretion provided you return the Router / modem or pay for the remainder of Term in full.

A brand-new service for all Digicel prepaid residential customers enabling advanced connectivity every 30 days, for 360 days with premium data* per 30 days.
How do I opt in?
By completing the Customer Details (above) and paying TOP$200 to begin using this Unlimited $200 Plan. You commit to 360 days with Digicel Tonga under this Unlimited $200 Plan (Term).
How long is this Unlimited Plan valid?
Once the Customer Details are completed and paid, the Unlimited $200 Plan is activated 30 days validity (commencing from the Creation Date) and you will be equipped with a new Router / modem. To secure ownership of the new Router / modem, you must complete the remaining 330 days of the Term whereby connectivity is TOP$$200 per 30 days**.
How do I continue using this Unlimited Plan?
After the first 30 days from the Creation Date, to continue using this Unlimited Plan you must continue to opt in for TOP$$200 on 30th day anniversary of the Creation Date for 300 days to use this Unlimited Plan*. For example, on 1 April you paid TOP$200 for the first 30 days validity which is from 1
April to 30 May then on 31 May you paid TOP$$200 to continue your 30 days use of this Unlimited Plan and continue to pay TOP$$200 every 30 days for 330 days (or roughly 11 months).
What do I need to know about this Unlimited Plan?
There are various terms and conditions set out below.
(1) FAIR USAGE*
Digicel Tonga network but at speeds to 2 mbps. No additional charges apply. Speeds at 2 mbps will alter your online experience. It is not suitable for high-definition video, high speed applications, dynamic web pages, social media content and file upload/download. These will be slower taking longer periods of time to interact with. Data intensive users (usually 1% of all users) may experience reduced speeds compared to moderate users during high data traffic periods. The speeds you receive may vary depending on a range of factors including your device, your locations, number of users and download sources. For residential, home and personal use only.
(2) RELATED TO UNLIMITED PLAN
§ Digicel Tonga general prepaid terms apply to this Offer and your use.
§ This Offer is for residential or home or personal entertainment use only (i.e. it is not for use in relation to or arising out of business or commerce).
§ Upon expiry of your 30 day validity, you may opt in again to renew your plan and continue your use (with the exception of the first 30 days of your use of this Unlimited Plan).
§ The Router and this Offer is specific to the Digicel Tonga Unlimited $200 service and you must not remove the Unlimited $200 SIM Card installed on the Router. If you remove the Unlimited $200 SIM Card and use it in any other device, Digicel Tonga may cancel your service, and your right to use the offer will end**.
§ The Unlimited $200 Plan does not rollover i.e. if you have not fully used your premium data by the end of 30 days or when it expires, the remaining data will be forfeited.

§ Digicel Tonga does not guarantee full and active connectivity at all times as various factors affect connectivity that include the location of your Router.
By signing up to the Unlimited $200 Plan you agree to use it reasonably, appropriately, in a manner that does not harm or is not excessive, in a manner that is legal and without causing significant congestion
This Unlimited Plan allows you uncapped 500GB data. Usage thereon will then be capped at 2mbps.
(3) ACCESS TO DIGICEL TONGA NETWORK
§ You will be able to receive Digicel Tonga services whenever your modem is within the operating range of the Digicel Tonga network. Digicel Tonga will use the service address information you give us (above) to check whether you fall within the Digicel Tonga network area, and whether Digicel Tonga can provide services to you.
§ Unfortunately, Digicel Tonga cannot absolutely guarantee you the availability of services in advance, as there may be places within the Digicel Tonga network area where you cannot receive the services, because of unusual terrain or other environmental or man-made circumstances beyond the immediate control of Digicel Tonga or its representatives. In these cases Digicel Tonga may recommend alternatives - some of which may have additional costs associated with them.
§ Acceptance or refusal of a recommended alternative is at your discretion and Digicel Tonga cannot be held responsible for non-availability of service should you decline a recommended solution and after all reasonable attempts have been made by Digicel Tonga.
§ Digicel Tonga does not represent or warrant that connectivity or related products and services shall be available in Tonga or in any other country.
(4) UNACCEPTABLE USAGE
§ By signing up to the Unlimited $200 Plan you agree to use it reasonably, appropriately, in a manner that does not harm or is not excessive, in a manner that is legal and without causing significant congestion or reduced network quality on the Digicel Tonga network**
§ You must not resell Digicel Tonga services or products without Digicel Tonga prior written approval to do so.
§ You must not engage in deceptive online marketing, posting, transmitting, re-transmitting or storing material on or through any of Digicel Tonga services or products that would violate any Tongan law or regulation.
You must not violate the rights of any person protected by copyright, trade secret, patent or other intellectual property or similar laws or regulations, including, but not limited to, the installation or distribution of pirated / unlicensed or other software products where you are not appropriately licensed to use. § or reduced network quality on the Digicel Tonga network**.
(3) CONTENT & INTELLECTUAL PROPERTY
§ All of Digicel Tonga official communication directly to you will be by email or alternative number or through our Social Media platforms. You agree as part of this Agreement to Digicel Tonga sending to you such emails and Digicel Tonga will uphold industrial standard, including for promotional material, when contacting you. You may ask to cease all promotional material to your email by informing Digicel Tonga to do so.
§ You are responsible for your behavior and preferences when accessing the internet using this Unlimited Plan. Digicel Tonga will not be liable for any loss, misuse or dissemination of your personal and private data arising out of your action (or inaction) that resulted in such loss, misuse or dissemination.
§ Digicel Tonga retains ownership of all its intellectual property and rights therein, including its products and devices in your possession.
(4) BEYOND DIGICEL TONGA CONTROL
§ Digicel Tonga is not responsible for repairing or replacing your Router or modem if it is damaged or defective due to your action (or inaction) due to abuse, misuse, neglect, mishandling or misapplication by you or a third party while such Router or modem is in your care.
(5) LIABILITY, INDEMNITY & VIOLATION
§ You agree that the use of this Unlimited Plan, including any content you may access or obtain through the Digicel Tonga network, is at your own risk.
§ You agree to indemnify and hold harmless Digicel Tonga from all liabilities, damages, claims, actions, proceedings and expenses, including any legal fees and expenses, arising out of or in connection with your use of the Digicel Tonga network.
§ Digicel Tonga reserves the right to suspend or terminate your use of this Unlimited Plan as a result of your breach of this Agreement and its terms and conditions. You may be notified by Digicel Tonga of your breach and required to remedy such breach within 5 calendar days. Failing such remedy, Digicel Tonga may suspend or terminate your use at its discretion.
(6) TERMINATION**
Digicel Tonga may end this Agreement without cause and for convenience at its discretion. It may also end this Agreement and recover the Router / modem from you should you discontinue opting in.
Digicel Tonga may monitor your use of this Offer to ensure you are complying with this Agreement and these terms and conditions. Where necessary, Digicel Tonga may investigate your use and involve law enforcement authorities (Police) without providing you advance notice.
Where Digicel Tonga believes you have used this Offer contrary to these terms and conditions, Digicel Tonga may exercise its right to slow, suspend, cancel or limit your use of your service.
Digicel Tonga may change these terms upon 30 days’ notice and in the event you disagree with such change, you may end your use of this Offer. No additional charges apply to your option to end your use of this Offer as a result of such change by Digicel Tonga.
